1) Definitions

1.1 “Gifts360,” “we,” “us,” “our” means Gifts360.
1.2 “Customer,” “you,” “your” means the person placing an order.
1.3 “Recipient” means the person receiving the order.
1.4 “Products” include flowers, cakes, chocolates and sweet treats, gourmet platters, personalized gifts, candles, wellness items, gift baskets, and corporate gifts.
1.5 “Perishable Products” means any product with limited shelf life or freshness sensitivity, including (without limitation) flowers, cakes, chocolates, sweet treats, and gourmet platters.
1.6 “Delivery Option” means the timeline selected at checkout (2-Hour Express, Same-Day, 24-Hour, 48-Hour, 72-Hour).
1.7 “Scheduled Delivery Time/Date” means the delivery date and/or time window selected at checkout or confirmed by us via WhatsApp/phone.
1.8 “Delivery Attempt” means a visit by our rider/courier to the provided address to complete delivery.

2) Order Placement and Acceptance

2.1 By placing an order, you confirm you have read and agree to these Terms & Conditions.
2.2 Orders are considered accepted only once confirmed by us (via website confirmation and/or WhatsApp coordination).
2.3 We may contact you for verification, clarifications, or substitutions; failure to respond may affect timelines.
2.4 We may decline or cancel an order in limited cases such as unserviceable locations, unavailability of key components, suspected fraud, or non-payment. If we cancel for reasons attributable to us, we will refund the amount paid for the affected order.

3) Pricing, Taxes, and Payment

3.1 Prices displayed are subject to change without notice; however, you will be charged the price confirmed at checkout or as confirmed in writing (including WhatsApp) prior to payment.
3.2 Taxes apply where applicable. The final payable amount will be shown at checkout or confirmed before payment is collected.
3.3 Payment method availability may vary; available options will be presented at checkout or during confirmation.
3.4 An order is not processed until payment is received (unless expressly agreed otherwise in writing by Gifts360).

4) Cancellations and Changes

4.1 No same-day cancellations. Once an order is placed for Same-Day or 2-Hour Express delivery, it cannot be cancelled.
4.2 No cancellations within 24 hours. Cancellation requests made within 24 hours of the Scheduled Delivery Time/Date are not eligible for any refund.
4.3 Cancellation window (24+ hours). If you request cancellation more than 24 hours before the Scheduled Delivery Time/Date, we will review the request based on fulfillment status and product type. Where cancellation is approved, any applicable payment gateway/processing charges may be deducted.
4.4 Changes vs. cancellations. A “change” includes edits to message cards, minor customizations, delivery instructions, or adding items. A “cancellation” means stopping the order entirely.
4.5 Additions allowed; no deductions. After an order is confirmed:

      4.5.1 Additions to an order may be accepted subject to feasibility, stock, and additional payment.

      4.5.2 Deductions/removals are not permitted (including removing items to reduce price), as procurement and preparation begin immediately after confirmation.
4.6 Perishable Products. For Perishable Products, changes may not be possible once preparation has started. We will confirm feasibility via WhatsApp/phone where possible.
4.7 All approved changes must be confirmed by us in writing (including WhatsApp) to be effective.

5) Delivery Responsibilities and Failed Delivery Attempts

5.1 Accurate details required. You are responsible for providing a complete and accurate delivery address, Recipient name, and working contact number(s).
5.2 Coordination at delivery. If delivery cannot be completed due to incorrect information, Recipient unavailability, restricted access, refusal, or inability to contact the Recipient, we will attempt coordination via WhatsApp/phone where reasonably possible.
5.3 Quality check responsibility (pre-dispatch). Gifts360 and/or its vendors perform quality checks prior to dispatch. Quality checking is not the Customer’s responsibility.
5.4 Single re-attempt policy. If delivery fails for reasons not attributable to Gifts360, we will make one (1) re-attempt within a feasible time window (as determined by route and operational constraints).
5.5 2-Hour Express + Perishable Products — no redelivery. For 2-Hour Express deliveries and/or Perishable Products, redelivery is not guaranteed and may not be possible due to freshness and product integrity requirements. In such cases, a re-attempt may be treated as the only attempt where feasible, or the order may be closed as “attempted” if freshness would be compromised.
5.6 Charges on failed delivery. If delivery remains unsuccessful after the permitted attempt(s) due to Customer/Recipient-related reasons (incorrect details, Recipient unavailable, refusal, etc.):

      5.6.1 You may be eligible for a refund of the product value (where applicable and at our discretion based on product condition); however,

      5.6.2 Delivery charges and the delivery attempt fee are non-refundable, and may be deducted from any refund.
5.7 Proof of attempt. We may record proof of delivery attempt (e.g., call logs, time-stamped location, security desk confirmation) for operational and dispute resolution purposes.
5.8 Safe drop / leave-at-door. If you request delivery to be left with reception/security/neighbor or left at the door, you accept responsibility once the order is handed over as instructed. Any such instruction must be clearly shared at the time of order/confirmation.

6) Product Quality, Perishables, and Care

6.1 Many of our Products are Perishable Products and are best enjoyed soon after delivery.
6.2 We are not responsible for quality issues caused by: (a) delayed receipt, (b) Recipient unavailability, (c) incorrect address/contact details, or (d) improper storage/handling after delivery.
6.3 Product presentation may vary slightly from website photos due to seasonal availability, natural variation (especially flowers), and packaging improvements.
6.4 Where applicable, care instructions may be shared with the Recipient; Customers are encouraged to ensure Recipients can receive Perishable Products promptly.

7) Substitutions

7.1 If a Product or component is unavailable, we may substitute with an item of similar type and comparable value to preserve the intended gifting experience.
7.2 Substitutions may be made due to seasonality, stock constraints, or vendor availability, particularly for flowers and Perishable Products.
7.3 If a key element is unavailable, we may contact you for approval; if we cannot reach you in time, we may proceed with a best-match substitution to protect delivery timelines.

8) Limitation of Liability

8.1 To the fullest extent permitted by law, Gifts360 is not liable for indirect, incidental, special, or consequential damages arising from an order, including loss of profit, goodwill, or opportunity.
8.2 Our total liability for any claim relating to an order is limited to the amount actually paid for the relevant order (excluding non-refundable delivery/attempt charges where applicable).
8.3 Delivery times are estimates based on operational conditions, traffic, weather, access restrictions, and Recipient availability. We will make reasonable efforts to meet the selected Delivery Option.

9) Intellectual Property

9.1 All website content, branding, product names, descriptions, designs, and visuals are owned by or licensed to Gifts360.
9.2 You may not copy, reproduce, distribute, modify, or use our intellectual property without prior written permission.

10) Privacy

10.1 We collect and use personal data (including Customer and Recipient details) to process orders, coordinate delivery, and provide customer support.
10.2 Our handling of personal data is described in our Privacy Policy.
10.3 By placing an order, you confirm you have the right to share Recipient information with us for delivery purposes.

11) Governing Law and Jurisdiction

11.1 These Terms & Conditions are governed by the laws of Pakistan.
11.2 The courts of Karachi, Pakistan shall have exclusive jurisdiction over any disputes arising out of or related to these Terms or any order placed with Gifts360.
